The immediate answer
What you need to know
A UK resident can buy property in France, but ownership does not create a right to live there. The legal process is led by a French notaire, while independent advice may be needed on ownership structure, preliminary terms, finance, tax and succession before the buyer commits.
The notaire and independent legal advice have different roles
The notaire is a French public officer responsible for the conveyancing process, title and collection of transaction taxes. A buyer may also obtain independent advice on the preliminary contract, ownership structure, financing conditions, company or SCI documents, cross-border tax and succession planning.
Typical purchase sequence
- 01
Clarify budget, financing, intended use and immigration position.
- 02
Agree an offer only after understanding any conditions and deadlines.
- 03
Review and sign the preliminary contract, including appropriate suspensive conditions.
- 04
Use the statutory cooling-off period where it applies.
- 05
Allow the notaire to complete title, planning and diagnostic checks.
- 06
Resolve financing, ownership, tax and succession issues before completion.
- 07
Transfer funds and sign the final acte authentique.
Questions to answer before the preliminary contract
- Will the property be a main home, second home, rental or business asset?
- Who should own it and in what proportions?
- Is an SCI or company being considered, and why?
- What finance condition and deadline is required?
- Do proposed works need consent or create planning risk?
- How do wills, marital property and succession interact with ownership?
- Does the intended occupation require a visa or residence status?
Treat percentage estimates as planning only
Acquisition costs depend on the property, transaction and tax rules. Online percentage ranges are not a quotation. The notaire should provide the transaction-specific estimate, and separate legal, finance, survey, translation and tax-advice costs should be identified.
Common questions
Questions people ask before taking the next step
Can a British citizen buy French property after Brexit?
Yes. The purchase and the right to reside are separate questions. A buyer must still comply with the applicable visit or long-stay rules.
Do I need my own lawyer as well as the notaire?
It is not mandatory for every purchase, but independent advice can be valuable where the preliminary contract, ownership, finance, construction, company, tax or succession issues are material.
Is an SCI always tax efficient?
No. An SCI is a legal structure with governance, tax and succession consequences. It should be selected for defined objectives after French and relevant UK advice.
